AN ACT

RELATING TO GUBERNATORIAL APPOINTMENTS; REQUIRING RECONFIRMATION BY THE SENATE OF CABINET SECRETARIES PROPOSED TO BE RETAINED IN A NEW TERM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 10-1-1 NMSA 1978 (being Laws 1915, Chapter 61, Section 1) is amended to read:

"10-1-1. RECONFIRMATION OF GOVERNOR'S APPOINTMENTS--INELIGIBILITY FOR RECESS APPOINTMENT.--

A. If a governor wants to retain a cabinet secretary from the preceding gubernatorial term, he shall resubmit the person's name for confirmation by the senate.

B. [No] A person whose nomination or appointment to any office in the state [shall have] has been rejected by the

senate shall not be eligible to hold office under recess appointment."
