SENATE FLOOR AMENDMENT number ___1___ to HOUSE BILL 984, as amended

1. On page 1, line 13, after the semicolon insert "CONFORMING CERTAIN SECTIONS OF THE ELECTION CODE TO THE REQUIREMENTS OF THE FEDERAL HELP AMERICA VOTE ACT OF 2002;".

2. On page 1, line 19, after "APPLICATION" insert "--FEDERAL QUALIFIED ELECTOR--OVERSEAS VOTER".

3. On page 1, line 20, after "elector" insert "or an overseas voter".

4. On page 2, line 8, after the period insert "The form shall allow the applicant to receive an absentee ballot for all elections within an election cycle.".

5. On page 2, line 13, strike the closing quotation mark.

6. On page 2, between lines 13 and 14, insert the following new subsection to read:

"D. An application for an absentee ballot by a federal qualified elector or an overseas voter shall be accepted at any time preceding the general election."".

7. On page 3, between lines 12 and 13, insert a new Subsection D to read:

"D. If the applicant has on file with the county a valid certificate of registration that indicates that the applicant is a voter who registered by mail without submitting the required identification, the county clerk shall notify the voter that he must submit with his absentee ballot a copy of a current and valid photo identification, utility bill, bank statement, government check, paycheck or other government document that shows the name and address of the applicant. The county clerk shall note on the absentee ballot register and signature roster that the applicant's absentee ballot must be returned with the required identification.".

8. Reletter the succeeding subsections accordingly.

9. On page 7, line 24, strike "and".

10. On page 7, between lines 24 and 25, insert the following new paragraph to read:

"(7) whether the voter is required to submit identification pursuant to Section 1-6-5 NMSA 1978; and".

11. Renumber the succeeding paragraph accordingly.

12. On page 8, line 4, remove the brackets and line-through and strike "After" and insert in lieu thereof "after".

13. On page 8, line 8, strike the underscored language.
