Mr. Speaker:

Your APPROPRIATIONS AND FINANCE COMMITTEE, to whom has been referred

HOUSE BILL 956

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 13, strike "AN" and insert in lieu thereof "A".

2. On page 1, line 25, strike "and" and insert in lieu thereof:

"B. "historic landscape" means a historic manmade or cultural landscape:

(1) that is limited in scope;

(2) generally comprising a plaza, square, park,

garden, terrace, streetscape, estate, grounds of a building or other open space designed formally or informally; and

(3) that has contributed to the cultural history of its time; and".

3. Reletter the succeeding subsection accordingly.

4. On page 2, line 15, strike "five" and insert in lieu thereof "three".

5. On page 2, between lines 17 and 18, insert the following new paragraph:

"(5) two New Mexico residents who are active members of garden clubs;".

6. Renumber the succeeding paragraphs accordingly.

7. On page 3, line 12, strike "an" and insert in lieu thereof "a".

8. On page 4, line 12, strike "an" and insert in lieu thereof "a".

9. On page 4, line 13, strike "; and" and between lines 13 and 14 insert the following new paragraphs:

"(1) that shall rely entirely upon acquisition of historic landscapes by purchase or gift;

(2) that shall not include a historic landscape in the system without the consent of all persons owning property rights in the historic landscape; and

(3) that shall not place limitations or restrictions on a person's use or freedom of alienation of a historic landscape by designation or otherwise without the free consent of the person; and".
