Mr. Speaker:
Your JUDICIARY COMMITTEE, to whom has been referred
HOUSE BILL 905, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. Strike House Business and Industry Committee Amendments 1 and 10.
2. On page 1, line 11, after the second semicolon insert "PROVIDING CRIMINAL PENALTIES;".
3. On page 6, line 15, after "NUMBER" insert "--PENALTY".
4. On page 6, line 22, after "used" strike the remainder of the line, strike line 23 in its entirety and insert in lieu thereof the following to read:
"in a manner consistent with state or federal law or as part of an application for credit or in connection with annuity or insurance transactions.".
5. On page 7, line 7, strike "that need the" and insert in lieu thereof "authorized to have access to that".
6. On page 7, line 10, strike "other" and insert in lieu thereof "unauthorized".
7. On page 7, between lines 10 and 11, insert the following new subsection to read:
"E. No employee, former employee or business owner shall reveal to another person, except to an employee authorized to have access, a consumer's social security number acquired pursuant to this section. Any person who violates the provisions of this subsection is guilty of a misdemeanor and shall be punished by a fine of not more than one thousand dollars ($1,000) or by imprisonment for a definite term not to exceed one year or both, together with costs of prosecution.".
8. On page 8, line 22, after "receipt" insert "to the cardholder".
9. On page 8, line 23, strike "four numbers" and insert in lieu thereof "five digits".
