Your APPROPRIATIONS AND FINANCE COMMITTEE, to whom has been referred

HOUSE EDUCATION COMMITTEE SUBSTITUTE FOR HOUSE BILL 745

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 2, line 19, after the period insert "For fiscal years 2004 and 2005, with the approval of the state superintendent, a school district or charter school may budget so much of its operational cash balance as is needed for nonrecurring expenditures, including capital outlay.".

2. On page 2, line 21, strike "2004" and insert in lieu thereof "2006".

3. On page 2, line 24, strike "school" and insert in lieu thereof "state".

4. On page 2, line 25, strike "Subsections F and H of".

5. On page 3, line 23, after "as" insert "otherwise" and strike "Subsections H and I of".

6. On page 3, line 24, after the comma insert "for the 2006 and subsequent fiscal years,".

8. On page 4, line 10, strike "actual operational" and insert in lieu thereof "excess".

9. On page 4, line 13, strike "excess cash balance is equal to" and insert in lieu thereof "reduction pursuant to this subsection shall equal".

10. On page 4, line 16, strike "actual operational" and insert in lieu thereof "excess".

11. On page 4, lines 17 and 18, strike "excess cash balance is equal to" and insert in lieu thereof "reduction pursuant to this subsection shall equal".
