RELATING TO MEDICAL PRACTICE; PROHIBITING CERTAIN PERSONS FROM REFERRING A PATIENT TO A HEALTH-RELATED BUSINESS IN WHICH THE PERSON HAS A FINANCIAL INTEREST; ENACTING A SECTION OF THE MEDICAL PRACTICE ACT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. REFERRAL--FINANCIAL INTEREST.--
A. A licensed physician or physician assistant shall not refer a patient for a service or for goods related to health care to a health facility, clinical laboratory, radiology facility or other health-related business in which the licensed physician or physician assistant has a financial interest.
B. The board may suspend the license or registration of a physician or physician assistant who fails to comply with the provisions of Subsection A of this section.
