AN ACT

RELATING TO PUBLIC WORKS; PROVIDING FOR POLITICAL SUBDIVISIONS TO ELECT FOR EXEMPTION FROM THE PUBLIC WORKS MINIMUM WAGE ACT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Public Works Minimum Wage Act is enacted to read:

"[NEW MATERIAL] EXEMPTION.--A municipality, county or school district may, by majority vote of all members of its governing body, elect to be exempt from the provisions of the Public Works Minimum Wage Act. For the purposes of this section, "governing body" means the governing body of a municipality, the board of county commissioners of a county or the local school board of a school district."

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2003.
