HOUSE FLOOR AMENDMENT number ___1__ to HOUSE JUDICIARY COMMITTEE SUBSTITUTE FOR HOUSE BILLS 501, 506 & 613

Amendment sponsored by Representative W. Ken Martinez

1. On page 1, line 25 and page 2, lines 1 through 3, strike the underscored language and insert in lieu thereof the following paragraph to read:

"(2) a brain injury resulting from a single traumatic work-related injury that causes, exclusive of the contribution to the impairment rating arising from any other impairment to any other body part, or any preexisting impairments of any kind, a permanent impairment of thirty percent or more as determined by the current American medical association guide to the evaluation of permanent impairment.".

2. On page 5, lines 22 through 25 and on page 6, lines 1 through 6, strike the underscored language.

3. On page 10, line 1, strike the semicolon and insert in lieu thereof a period, strike the remainder of the line and on lines 2 through 10 strike the underscored language.

4. On page 12, between lines 3 and 4, insert a new section to read:

"Section 4. APPLICABILITY.--The provisions of this act are effective for all injuries in which the worker reaches maximum medical improvement on or after July 1, 2003.".
