A JOINT MEMORIAL

REQUESTING THE STATE BOARD AND LOCAL SCHOOL BOARDS TO REPORT PROGRESS ON PROVISION OF SUPPLEMENTAL EDUCATIONAL SERVICES.

 

WHEREAS, in 2000, the legislature passed amendments to the social promotion statute that requires remediation and academic improvement programs for failing students, including tutoring, summer school and extended day programs; and

WHEREAS, the law requires the school district to pay the costs of remediation for students in grades one through eight; and

WHEREAS, the federal No Child Left Behind Act of 2001 contains a provision that requires the local education agency serving certain schools to "arrange for the provision of supplemental educational services to eligible children in the school from a provider with a demonstrated record of effectiveness, that is selected by the parents and approved for that purpose by the state educational agency in accordance with reasonable criteria..."; and

WHEREAS, the state department of public education released a request for proposals in September 2002 and selected seven supplemental educational services providers to provide tutoring for students in probationary schools; and


WHEREAS, school districts with probationary schools are developing plans to advise parents about their options and to provide lists of the providers;

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the state department of public education and local school boards report to the legislative education study committee by September 1, 2003 on their progress on providing supplemental educational services to remedial students and students in probationary schools, including each school district's supplemental educational services implementation plan; the amount of money appropriated by each school district for supplemental educational services for each category of students; the amount expended; and any other information required by the committee; and

BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the state department of public education for distribution and to the legislative education study committee.
