REQUESTING THAT THE DEPARTMENT OF PUBLIC SAFETY DEVELOP A TASK FORCE TO EXAMINE ISSUES REGARDING THE COLLECTION AND DISSEMINATION OF INFORMATION ON SEX OFFENDERS.
WHEREAS, the Sex Offender Registration and Notification Act provides for public access to information on certain registered sex offenders, including the sex offender's name, address and physical characteristics; the sex offense for which he was convicted; and a photograph of the sex offender; and
WHEREAS, to maximize public safety, it is vitally important that the collection and dissemination of that information is complete and accurate; and
WHEREAS, the department of public safety is the lead agency responsible for the administration of the Sex Offender Registration and Notification Act, as its duties include management of a central registry of sex offenders and an internet site that provides the public with information on certain sex offenders;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the department of public safety be requested to develop a task force to examine issues regarding the collection and dissemination of information on sex offenders, pursuant to the Sex Offender Registration and Notification Act; and
BE IT FURTHER RESOLVED that a member of the house of representatives appointed by the speaker of the house of representatives, a member of the house of representatives appointed by the minority floor leader of the house of representatives, a member of the senate appointed by the president pro tempore of the senate, a member of the senate appointed by the minority floor leader of the senate, a representative of the governor's office, a municipal police chief, a county sheriff, a district attorney and a district court judge be invited to be participants of the task force; and
BE IT FURTHER RESOLVED that the task force report its findings and recommendations to an appropriate legislative interim committee prior to November 1, 2002; and
BE IT FURTHER RESOLVED that a copy of this memorial be transmitted to the secretary of public safety.
