SUMMARY

 

     Synopsis of Bill

 

Senate Bill 428 proposes to require mandatory posting of public notices in the workplace to comply with U.S. Supreme Court decisions regarding employee rights on the use of collected union dues and mandatory reporting by employers regarding collected union dues.  The Labor and Industrial Division of the New Mexico Labor Department is charged with the production and distribution of such posters.  Additionally, the bill requires that if withheld union dues or fees are to be used for political purposes, the employer must obtain written permission from the employee annually.  Unions that engage in mandatory withholding of dues or fees must report annually to the Secretary of State the amounts withheld in at least the following categories:

 

  1. Collective bargaining;
  2. Organizing;
  3. Developing safety programs in the workplace;
  4. Partisan political campaigns and contributions;
  5. Political issue education; and
  6. Voter registration.

FISCAL IMPLICATIONS

 

The bill does not contain an appropriation or significant fiscal implication.  The Labor and Industrial Division of the Labor Department indicates that there is an approximate cost of $6.8 for the production and distribution of the public notices which will be absorbed in the division operating budget.
