SUMMARY
Synopsis
of Bill
Senate bill 413 appropriates
$775.0 from the general fund to the Local Government Division of the Department
of Finance and Administration for the purpose of establishing an office of
emergency preparedness in the city of Albuquerque to provide support to local
emergency response agencies statewide.
Significant
Issues
According to the Attorney General’s Office, “Currently the Department of Public Safety is in charge of and houses the state emergency response functions. The department has an established and functioning structure to interface and support local and county emergency preparedness statewide. The department’s office of emergency management has managers who oversee local and county emergency response issues and functions. SB 413 may be duplicative of the already existing functions of and programs at the Department of Public Safety.”
According to the New Mexico Department of Public Safety, the State
Civil Emergency Preparedness Act assigns responsibility to the New Mexico
Department of Public Safety for statewide emergency preparedness.
FISCAL IMPLICATIONS
The appropriation of
$775.0 contained in this bill is a recurring expense to the general fund. Any
unexpended or unencumbered balance remaining at the end of FY03 shall revert to
the general fund.
ADMINISTRATIVE IMPLICATIONS
None reported.
CONFLICT/DUPLICATION/COMPANIONSHIP/RELATIONSHIP
This bill relates to SB 115 and HB 154, NMIMT Homeland Security Center, both
of which allocate $500,000 for establishment of a Homeland Security Center at
New Mexico Tech in Socorro. This bill
also relates to SB149, which amends Section 13-1-127 NMSA 1978, Public
Purchases and Property, to include additional language and situations for
the purposes identifying an emergency and defines the financial reporting
process for all money expended for planning and preparing for an emergency
response.
OTHER SUBSTANTIVE ISSUES
The Office of Emergency Services and Security (OESS), a subdivision of
the New Mexico Department of Public Safety, provides statewide emergency
management services. Currently the City
of Albuquerque has an Office of Emergency Preparedness (OEP) that provides
emergency management services to the city of Albuquerque. According to the New Mexico Department of
Public Safety, the OEP has no responsibility to provide statewide services,
however, as partners with the OESS and Local Offices of Emergency Preparedness;
they do assist in statewide emergencies.
