SUMMARY

 

     Synopsis of Bill

 

House Bill 194 appropriates $200.0 from the general fund to the Office of Cultural Affairs for a statewide performing arts touring program by major performing arts institutions.

 

     Significant Issues

 

The major performing arts institutions must have shown a significant and consistent history of and commitment to performing arts touring and must have provided performing arts services in two or more counties outside of their home communities during each of the last five years.

 

FISCAL IMPLICATIONS

 

The appropriation of $200.0 contained in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance remaining at the end of FY03 shall revert to the general fund.

 

ADMINISTRATIVE IMPLICATIONS

 

Passage of this bill would require the Office of Cultural Affairs to conduct the request for proposal (RFP) process as required by the state procurement process and the anti-donation laws.  This process would require existing staff to spend some work time developing an RFP, publishing the RFP and reviewing and selecting eligible applicants and to oversee completion of the project.

OTHER SUBSTANTIVE ISSUES

 

The Office of Cultural Affairs expresses marginal concerns that the funds allocated may duplicate are services contracts already available to performing arts groups for touring and other research programs.  Generally, funds appropriated to the Office of Cultural Affairs are made available to any performing arts groups regardless of size.  The State Department of Education, however states there are very few programs like this available to the New Mexico community.
