SUMMARY

 

     Synopsis of HAGC Amendment

 

The committee changed the revenue source to General Fund from the Irrigation Works Construction Fund and added a reporting requirement by the Acequia De Alcalde to the 2005 legislature.

 

     Synopsis of Original Bill

 

House Bill 173 appropriates $25.0 from the Irrigation Works Construction Fund to the Local Government Division of the Department of Finance and Administration (DFA) for the purpose of funding a model water rights protection project, including the identification and acquisition of available water rights at acequia de Alcalde.

 

     Significant Issues

 

OSE states that could be benefit from information gathered by the project if water rights owners file changes of ownerships and other administrative documents that are not on file.  The agency assumes that the acequia will acquire water rights from individual holders within the acequia.  However, the Interstate Stream Commission has not authorized the project and expenditures will reduce the fund balance.

 


FISCAL IMPLICATIONS

 

The appropriation of $25.0 contained in this bill is a non-recurring expense to the Irrigation Works Construction Fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the general fund.

 

TECHNICAL ISSUES

 

Change line 24 to read:  “fiscal year 2004 shall revert to the irrigation works construction fund.”  OSE recommends a detailed description of the Acequia de Alcalde in case there are districts with similar names.
