SUMMARY
Synopsis
of Bill
House Bill 112 establishes the “Sport Shooting Range Act”
to provide standards of immunity from nuisance actions based on noise or noise
pollution. The act would ”grandfather”
all existing shooting ranges. The act
also provides for local government regulation of location and construction of
sport shooting ranges after July 2002.
The language releases the owner of a shooting range from nuisance actions
by persons affected by the operation of the range.
Significant
Issues
·
The grant of immunity to these shooting ranges from
nuisance actions based on noise or noise pollution brought by property owners
who acquire property after the shooting range has been in existence.
·
The provisions of the Sport Shooting Range Act do not
apply if the operation or use of a sport shooting range adversely affects
public health or public safety.
