RELATING TO THE ATTORNEY GENERAL; ESTABLISHING A DIVISION WITHIN THE OFFICE OF THE ATTORNEY GENERAL TO ADDRESS CONCERNS RELATED TO THE PROVISIONS OF THE TREATY OF GUADALUPE HIDALGO; ENACTING A NEW SECTION OF THE NMSA 1978; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of Chapter 8, Article 5 NMSA 1978 is enacted to read:
"[NEW MATERIAL] GUADALUPE HIDALGO TREATY DIVISION--REPORT.--
A. The "Guadalupe Hidalgo treaty division" is established within the office of the attorney general.
B. The Guadalupe Hidalgo treaty division shall review, oversee and address concerns relating to the provisions of the Treaty of Guadalupe Hidalgo that have not been implemented or observed, pursuant to the provisions of Article 2, Section 5 of the constitution of New Mexico and Section 47-1-25 NMSA 1978.
C. The attorney general shall appoint personnel for and designate the duties of the Guadalupe Hidalgo treaty division.
D. The attorney general shall produce an annual report regarding the findings and recommendations of the Guadalupe Hidalgo treaty division."
Section 2. APPROPRIATION.--Two hundred thousand dollars ($200,000) is appropriated from the general fund to the office of the attorney general for expenditure in fiscal year 2003 to provide a salary and benefits, equipment and supplies for a full-time employee to staff the Guadalupe Hidalgo treaty division. Any unexpended or unencumbered balance remaining at the end of fiscal year 2003 shall revert to the general fund.
Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2002.
