HOUSE FLOOR AMENDMENT number ___1___ to HOUSE APPROPRIATIONS AND FINANCE COMMITTEE SUBSTITUTE FOR HOUSE BILL 451

Amendment sponsored by Representative Ben Lujan

1. On page 3, line 9, strike "year" and insert in lieu thereof "years" and after "2003" insert "and 2004".

2. On page 3, line 14, after "section" insert "; provided that no less than one-third of the total amount expended from each increment shall be used to comply with New Mexico's obligations under the Pecos River Compact".

3. On page 3, between lines 19 and 20, insert the following paragraph:

"(2) a certification by the governor to the state board of finance that, after the transfer, the sum of the remaining balances in the appropriation contingency fund, the general fund operating reserve and the tax stabilization reserve will not be less than five percent of the recurring general fund appropriations for the prior fiscal year;".

4. Renumber the succeeding paragraphs accordingly.

5. On page 3, line 22, after "finance" insert "after review by the water trust board".

6. On page 3, after line 25, insert the following new subsection:

"B. The interstate stream commission shall make periodic reports on expenditures made pursuant to this section to the water trust board, the legislative finance committee and the appropriate interim legislative committee.".

7. Reletter the succeeding subsection accordingly.

8. On page 4, line 2, strike "2003" and insert in lieu thereof "2004".
