AN ACT

MAKING AN APPROPRIATION TO THE STATE BOARD OF FINANCE FOR EMERGENCIES FACING NEW MEXICO; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--

A. Two million two hundred thousand dollars ($2,200,000) is appropriated from the general fund to the state board of finance for expenditure in fiscal year 2002 for emergency purposes as follows:

(1) one million three hundred thousand dollars ($1,300,000) for the office of the attorney general to pursue water litigation with Texas;

(2) four hundred fifty thousand dollars ($450,000) for the Cumbres and Toltec scenic railroad commission for matching funds for operations and maintenance expenses;

(3) two hundred fifty thousand dollars ($250,000) for the district attorney of the eleventh judicial district for the prosecution of a capital murder case in consultation with the attorney general; and

(4) two hundred thousand dollars ($200,000) for other emergency contingencies.

B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2002 shall revert to the general fund.

Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
