RELATING TO THE REDISTRICTING OF THE HOUSE OF REPRESENTATIVES; ESTABLISHING REPRESENTATIVE DISTRICTS; PROVIDING THE METHOD FOR ELECTING REPRESENTATIVES; PROVIDING FOR THE FILLING OF VACANCIES; FIXING THE NUMBER, RESIDENCE AND TERMS OF REPRESENTATIVES; REPEALING AND ENACTING SECTIONS OF THE NMSA 1978.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. SHORT TITLE.--This act may be cited as the "2001 House Redistricting Act".

Section 2. MEMBERSHIP.--The house of representatives is composed of seventy members to be elected from districts that are contiguous and that are as compact as is practical.

Section 3. RESIDENCE.--At the time of filing a declaration of candidacy for the office of state representative, a candidate shall reside in the district for which he files. Thereafter, if a representative permanently removes his residence from or maintains no residence in the district from which he was elected, he shall be deemed to have resigned and his successor shall be selected as provided in Section 4 of the 2001 House Redistricting Act.

Section 4. ELECTIONS--VACANCIES.--

A. Members of the house of representatives shall be elected for terms of two years.

B. If a vacancy occurs in the office of representative for any reason, the vacancy shall be filled as follows:

(1) for a representative district that is situated wholly within the exterior boundaries of a single county, the board of county commissioners of that county shall appoint the representative to fill the vacancy; and

(2) for a representative district situated within two or more counties:

(a) the board of county commissioners of each county in the representative district shall submit one name to the governor; and

(b) the governor shall appoint the representative to fill the vacancy from the list of names so submitted.

C. An appointment to fill a vacancy in the house of representatives shall be for a term ending on December 31 after the next general election.

D. An appointment to fill a vacancy made before the general election of 2002 shall be made from the district as it was described in Laws 1991 (1st. S.S.), Chapter 2, Sections 8 through 77. After the general election of 2002, a vacancy shall be filled by appointment from the district set out in the 2001 House Redistricting Act.

Section 5. PRECINCTS.--

A. Precinct designations and boundaries used in the 2001 House Redistricting Act are those precinct designations and boundaries established pursuant to the Precinct Boundary Adjustment Act and revised and approved pursuant to that act by the secretary of state as of August 31, 2001.

B. A board of county commissioners shall not create any precinct that lies in more that one representative district and shall not divide any precinct so that the divided parts of the precinct are situated in two or more representative districts. Votes cast in a statewide election from precincts created or divided in violation of this subsection are invalid and shall not be counted or canvassed.

Section 6. DISTRICTS.--The districts of the house of representatives shall be as set out in Sections 7 through 76 of the 2001 House Redistricting Act.

Section 7. REPRESENTATIVE DISTRICT ONE.--Representative district one is composed of San Juan county precincts 20, 22 through 31, 42, 43, 49, 51, 52 and 58.

Section 8. REPRESENTATIVE DISTRICT TWO.--Representative district two is composed of San Juan county precincts 21, 40, 41, 44 through 47, 53 through 57, 59, 67 and 79.

Section 9. REPRESENTATIVE DISTRICT THREE.--Representative district three is composed of San Juan county precincts 60 through 66 and 68 through 76.

Section 10. REPRESENTATIVE DISTRICT FOUR.--Representative district four is composed of San Juan county precincts 2 through 4, 8 through 14, 18, 19, 81, 82 and 84.

Section 11. REPRESENTATIVE DISTRICT FIVE.--Representative district five is composed of McKinley county precincts 19, 21 and 31 through 50.

Section 12. REPRESENTATIVE DISTRICT SIX.--Representative district six is composed of Cibola county precincts 5 through 8, 12, 13 and 15; and McKinley county precincts 18 and 24 through 30.

Section 13. REPRESENTATIVE DISTRICT SEVEN.--Representative district seven is composed of Valencia county precincts 4, 6, 8 through 11, 15, 16, 18, 19, 28, 32, 36 and 38.

Section 14. REPRESENTATIVE DISTRICT EIGHT.--Representative district eight is composed of Valencia county precincts 1 through 3, 7, 12, 17, 21 through 27, 35 and 37.

Section 15. REPRESENTATIVE DISTRICT NINE.--Representative district nine is composed of McKinley county precincts 1, 3 through 8, 20, 22 and 23; and San Juan county precincts 1, 5 through 7, 15, 16, 83, 85 and 86.

Section 16. REPRESENTATIVE DISTRICT TEN.--Representative district ten is composed of Bernalillo county precincts 93 through 96, 98, 99, 102 through 106, l35, 246 and 258; and Valencia county precincts 5, 13 and 14.

Section 17. REPRESENTATIVE DISTRICT ELEVEN.--Representative district eleven is composed of Bernalillo county precincts 101, 125, 131 through 133, 150, 151, 153, 154, 161 through 166, 197, 211, 212, 214, 215, 217, 221, 223 through 226, 241 and 242.

Section 18. REPRESENTATIVE DISTRICT TWELVE.--Representative district twelve is composed of Bernalillo county precincts 54, 71 through 77, 88, 90 through 92 and 97.

Section 19. REPRESENTATIVE DISTRICT THIRTEEN.--Representative district thirteen is composed of Bernalillo county precincts 32, 41 through 44 and 49 through 53.

Section 20. REPRESENTATIVE DISTRICT FOURTEEN.--Representative district fourteen is composed of Bernalillo county precincts 33 through 36, 45 through 48, 61 through 67 and 121 through 124.

Section 21. REPRESENTATIVE DISTRICT FIFTEEN.--Representative district fifteen is composed of Bernalillo county precincts 3 through 10, 13, 16 through 18, 86, 410, 422 and 423.

Section 22. REPRESENTATIVE DISTRICT SIXTEEN.--Representative district sixteen is composed of Bernalillo county precincts 23, 27 through 29, 37 through 40, 55 and 120.

Section 23. REPRESENTATIVE DISTRICT SEVENTEEN.--Representative district seventeen is composed of Bernalillo county precincts 11, 12, 14, 15, 152, 180 through 187, 191 through 196, 347 and 438.

Section 24. REPRESENTATIVE DISTRICT EIGHTEEN.--Representative district eighteen is composed of Bernalillo county precincts 20 through 22, 24 through 26, 30, 81, 83 and 111 through 114.

Section 25. REPRESENTATIVE DISTRICT NINETEEN.--Representative district nineteen is composed of Bernalillo county precincts 107, 243 through 245, 251 through 257, 271 through 275, 278, 281, 282, 284, 311, 312, 353 and 381 through 384.

Section 26. REPRESENTATIVE DISTRICT TWENTY.--Representative district twenty is composed of Bernalillo county precincts 289, 290, 293 through 301 and 328 through 333.

Section 27. REPRESENTATIVE DISTRICT TWENTY-ONE.--Representative district twenty-one is composed of Bernalillo county precincts 283, 285 through 287, 318, 321 through 323, 326, 327, 477 and 478.

Section 28. REPRESENTATIVE DISTRICT TWENTY-TWO.--Representative district twenty-two is composed of Bernalillo county precincts 303, 551 through 559, 571 and 573; Sandoval county precincts 5, 6, 28 and 56; and Torrance county precincts 3 through 5.

Section 32. REPRESENTATIVE DISTRICT TWENTY-SIX.--Representative district twenty-six is composed of Bernalillo county precincts 291, 292, 316, 317, 413, 416, 417, 463 through 465, 471 through 476, 502, 533 through 536 and 542 through 545.

Section 33. REPRESENTATIVE DISTRICT TWENTY-SEVEN.--Representative district twenty-seven is composed of Bernalillo county precincts 407, 418 through 421, 426, 427, 450, 482, 485 through 490, 510, 538, 563, 568 and 601.

Section 34. REPRESENTATIVE DISTRICT TWENTY-EIGHT.--Representative district twenty-eight is composed of Bernalillo county precincts 302, 304 through 308, 503 through 505, 517 through 519, 524, 525, 531, 532, 540, 546 through 550 and 561.

Section 35. REPRESENTATIVE DISTRICT TWENTY-NINE.--Representative district twenty-nine is composed of Bernalillo county precincts 1, 2, 80, 82, 84, 85, 87 and 89.

Section 36. REPRESENTATIVE DISTRICT THIRTY.--Representative district thirty is composed of Bernalillo county precincts 314, 315, 373, 400 through 406, 408, 409, 411, 412, 434, 435, 439 through 441, 445, 446, 481, 491 through 493, 497, 498 and 500.

Section 37. REPRESENTATIVE DISTRICT THIRTY-ONE.--Representative district thirty-one is composed of Bernalillo county precincts 428 through 430, 449, 451, 452, 454, 480, 483, 520 through 522, 526, 527, 530, 537, 564 through 566 and 602.

Section 38. REPRESENTATIVE DISTRICT THIRTY-TWO.--Representative district thirty-two is composed of Luna county.

Section 39. REPRESENTATIVE DISTRICT THIRTY-THREE.--Representative district thirty-three is composed of Dona Ana county precincts 18, 38 through 40, 48 through 50, 53 through 58, 78, 98 and 101.

Section 40. REPRESENTATIVE DISTRICT THIRTY-FOUR.--Representative district thirty-four is composed of Dona Ana county precincts 7 through 12, 74, 79, 80, 96 and 104.

Section 44. REPRESENTATIVE DISTRICT THIRTY-EIGHT.--Representative district thirty-eight is composed of Dona Ana county precinct 60; Grant county precincts 1 through 7, 10, 12 through 15 and 29; Hidalgo county precinct 4; and Sierra county.

Section 45. REPRESENTATIVE DISTRICT THIRTY-NINE.--Representative district thirty-nine is composed of Grant county precincts 8, 9, 11, 16 through 28 and 30 through 34; and Hidalgo county precincts 1 through 3, 5 and 6.

Section 46. REPRESENTATIVE DISTRICT FORTY.--Representative district forty is composed of Mora county precinct 5; Rio Arriba county precincts 1 through 6, 10, 13 through 17, 37, 38, 40 and 41; San Miguel county precinct 9; Santa Fe county precinct 58; and Taos county precincts 20, 22 through 24, 27, 28 and 30 through 32.

Section 47. REPRESENTATIVE DISTRICT FORTY-ONE.--Representative district forty-one is composed of Rio Arriba county precincts 7 through 9, 11, 12, 18 through 20, 22 through 27, 29 through 36 and 39; Sandoval county precincts 21 through 23; and Taos county precinct 1.

Section 48. REPRESENTATIVE DISTRICT FORTY-TWO.--Representative district forty-two is composed of Taos county precincts 2, 4 through 19, 21, 26 and 33 through 35.

Section 49. REPRESENTATIVE DISTRICT FORTY-THREE.--Representative district forty-three is composed of Los Alamos county; Sandoval county precincts 7, 10, 18 and 51; and Santa Fe county precincts 12 and 80.

Section 50. REPRESENTATIVE DISTRICT FORTY-FOUR.--Representative district forty-four is composed of Sandoval county precincts 11 through 13, 32 through 36, 38, 48, 49, 53, 54 and 59 through 62.

Section 51. REPRESENTATIVE DISTRICT FORTY-FIVE.--Representative district forty-five is composed of Santa Fe county precincts 38, 39, 49, 62, 64, 66, 67, 74, 75 and 86.

Section 52. REPRESENTATIVE DISTRICT FORTY-SIX.--Representative district forty-six is composed of Santa Fe county precincts 1 through 11, 21, 23, 28, 30, 40, 59 through 61, 79, 82 and 83.

Section 55. REPRESENTATIVE DISTRICT FORTY-NINE.--Representative district forty-nine is composed of Catron county; Socorro county; and Valencia county precincts 20, 31 and 33.

Section 56. REPRESENTATIVE DISTRICT FIFTY.--Representative district fifty is composed of Santa Fe county precincts 15, 16, 18, 73, 84 and 85; Torrance county precincts 1, 2, 6 through 10 and 13; and Valencia county precincts 29, 30 and 34.

Section 57. REPRESENTATIVE DISTRICT FIFTY-ONE.--Representative district fifty-one is composed of Dona Ana county precincts 5, 6, 59, 64, 66 and 77; and Otero county precincts 15, 16, 26, 27, 30 through 33, 35 and 39.

Section 58. REPRESENTATIVE DISTRICT FIFTY-TWO.--Representative district fifty-two is composed of Dona Ana county precincts 13 through 17, 19, 81, 82 and 97.

Section 59. REPRESENTATIVE DISTRICT FIFTY-THREE.--Representative district fifty-three is composed of Otero county precincts 8, 9, 17 through 25, 34, 36 and 40.

Section 60. REPRESENTATIVE DISTRICT FIFTY-FOUR.--Representative district fifty-four is composed of Dona Ana county precincts 75 and 76; Eddy county precincts 2, 3, 7, 9 through 15, 29, 30, 35, 38, 40 and 43; and Otero county precincts 1 through 7.

Section 61. REPRESENTATIVE DISTRICT FIFTY-FIVE.--Representative district fifty-five is composed of Eddy county precincts 6, 16 through 21, 23, 25 through 28, 33, 34, 36, 37, 39, 44 and 45.

Section 62. REPRESENTATIVE DISTRICT FIFTY-SIX.--Representative district fifty-six is composed of Lincoln county precincts 8 through 11; and Otero county precincts 10 through 14, 28, 29, 37 and 38.

Section 63. REPRESENTATIVE DISTRICT FIFTY-SEVEN.--Representative district fifty-seven is composed of Chaves county precincts 1 through 7, 9, 11, 13 through 16, 21, 22, 24, 25 and 41; and Eddy county precincts 1, 4, 5, 8 and 42.

Section 64. REPRESENTATIVE DISTRICT FIFTY-EIGHT.--Representative district fifty-eight is composed of Chaves county precincts 34, 42, 43, 51, 52, 61 through 63, 71 through 73, 90 through 92 and 101 through 104; and Eddy county precinct 41.

Section 66. REPRESENTATIVE DISTRICT SIXTY.--Representative district sixty is composed of Sandoval county precincts 30, 31, 37, 39 through 47 and 67.

Section 67. REPRESENTATIVE DISTRICT SIXTY-ONE.--Representative district sixty-one is composed of Eddy county precincts 31 and 32; and Lea county precincts 31, 34 through 36, 43, 44, 51 through 55, 61, 62 and 71 through 74.

Section 68. REPRESENTATIVE DISTRICT SIXTY-TWO.--Representative district sixty-two is composed of Lea county precincts 10, 11, 15 through 18, 20 through 30, 32, 33, 41 and 42.

Section 69. REPRESENTATIVE DISTRICT SIXTY-THREE.--Representative district sixty-three is composed of Curry county precincts 1, 3 through 9, 16, 25 through 30, 34 and 36; De Baca county; Guadalupe county; and Roosevelt county precinct 6.

Section 70. REPRESENTATIVE DISTRICT SIXTY-FOUR.--Representative district sixty-four is composed of Curry county precincts 2, 10 through 15, 17 through 24, 31, 32, 35 and 37.

Section 71. REPRESENTATIVE DISTRICT SIXTY-FIVE.--Representative district sixty-five is composed of Bernalillo county precinct 31; Cibola county precincts 1 through 3 and 17; and Sandoval county precincts 8, 9, 14 through 17, 19, 20, 27, 50, 58 and 63.

Section 72. REPRESENTATIVE DISTRICT SIXTY-SIX.--Representative district sixty-six is composed of Curry county precinct 33; Lea county precincts 2, 3 and 12 through 14; and Roosevelt county precincts 1 through 5 and 7 through 18.

Section 73. REPRESENTATIVE DISTRICT SIXTY-SEVEN.--Representative district sixty-seven is composed of Colfax county precincts 5, 7 and 10 through 22; Harding county; Quay county; San Miguel county precinct 15; and Union county.

Section 74. REPRESENTATIVE DISTRICT SIXTY-EIGHT.--Representative district sixty-eight is composed of Colfax county precincts 1 through 4; Mora county precincts 1 through 4 and 6 through 11; San Miguel county precincts 2, 4 through 6, 10 through 12, 14 and 25 through 28; and Taos county precincts 3, 25 and 29.

Section 75. REPRESENTATIVE DISTRICT SIXTY-NINE.--Representative district sixty-nine is composed of Cibola county precincts 4, 9 through 11, 14 and 16; McKinley county precincts 9 through 17; and Sandoval county precincts 24 through 26.

Section 76. REPRESENTATIVE DISTRICT SEVENTY.--Representative district seventy is composed of San Miguel county precincts 1, 3, 7, 8, 13 and 16 through 24; Santa Fe county precincts 13, 17, 19, 57, 63, 65, 69 and 71; and Torrance county precincts 11 and 12.

Section 77. ELECTION OF REPRESENTATIVES.--Representatives shall be elected from the districts described in the 2001 House Redistricting Act at the 2002 and subsequent general elections.

Section 78. REPEAL.--Sections 2-7C-1 through 2-7C-78 NMSA 1978 (being Laws 1991 (1st S.S.), Chapter 2, Sections 1 through 78) are repealed.
