PROPOSING TO AMEND ARTICLE 8 OF THE CONSTITUTION OF NEW MEXICO BY ADDING A NEW SECTION TO LIMIT THE USE OF REVENUES FROM STATE TAXES IMPOSED ON THE SALE, USE OR RECEIPT OF GASOLINE AND OTHER MOTOR FUELS.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. It is proposed to amend Article 8 of the constitution of New Mexico by adding a new section to read:
"After June 30, 2003, revenue from state taxes imposed on the sale of or for the privilege of using or receiving gasoline and any other fuel used to generate power to propel a motor vehicle and state taxes or fees on the sale of motor vehicles shall be used solely for appropriation by the legislature to the state highway and transportation department or its successor agency for road or highway planning, design, construction, repair or maintenance; acquisition of rights of way; other highway and transportation purposes; or for distribution to municipalities or counties for those purposes; and for administration of the department."
Section 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date which may be called for that purpose.
