SUMMARY
Synopsis of Bill
Senate Joint Resolution 4 amends the statute that relates to the acquisition of lands for park and recreational purposes by the State Parks Division of the Energy, Minerals and Natural Resources Department (EMNRD). The Resolution would approve a proposal by EMNRD to purchase lands adjacent to the boundaries of Coyote Creek, Oliver Lee Memorial, and Pancho Villa State Parks. The funding for the purchases would be derived from the federal government and other sources.
Significant Issues
Section 16-2-11 NMSA 1978 requires the State Parks Division to obtain legislative approval before formalizing the acquisition of lands adjacent to state parks, for inclusion into those parks. If enacted, SJR 4 would give the department the necessary legislative approval to move forward with the purchase of these lands.
This statute also requires the department to conduct a feasibility study of the purchase to determine that the acquisition meets the requirements set out in this section of the statutes. The department has provided this study in its management plans for each of these parks.
FISCAL IMPLICATIONS
Senate Joint Resolution 4 does not carry an appropriation. The funding ($433.2) for the acquisition of the land has been appropriated by the federal government.
ADMINISTRATIVE IMPLICATIONS
Enactment of the bill would impose an additional administrative burden on the department, but it is adequately staffed to manage the increased workload.
