SUMMARY



Synopsis of Bill



Senate Indian and Cultural Affairs Committee Substitute for Senate Bill 850 appropriates $200.0 to the New Mexico Office of Indian Affairs to address domestic abuse protection orders for women, children and families and to work to provide comity and cross-jurisdictional enforcement of those domestic abuse protection orders. The amount appropriated is to be expended in fiscal year 2001 and is a recurring cost to the general fund. Any balance remaining at the end of fiscal year 2002 shall revert to the general fund.



Significant Issues



It is unclear as to the focus of the bill and the appropriation. Because the funds are appropriated to the New Mexico Office of Indian Affairs, it seems that the intent is to utilize these funds for the Indian community. However, this in not specified in the bill. As worded, it would seem that the scope of this bill would fall under the purview of the Department of Public Safety or the Children, Youth & Families Department, who would address such concerns on a statewide basis. However, the agency may coordinate with the public safety agencies of the various pueblos and tribes to expend these funds.









FISCAL IMPLICATIONS



The appropriation of $200.0 contained in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2002 shall revert to the general fund. The bill contains an emergency clause, however the text indicates the appropriation is to be expended in fiscal year 2002.
