SUMMARY
Synopsis of Bill
SB759 requires peace officers to report violations of the motor vehicle code to the State Departments Bureau of Diplomatic Security when the driver presents a driver's licenses issued by the State Department. Officer must verify the validity of the license and must forward copies of all documents issued pursuant to the stop.
FISCAL IMPLICATIONS
DPS reports there is fiscal impact on the department from passage of SB759. The proposed legislation states that when a peace officer is presented with a driver's license issued by the United States Department of State, the officer shall immediately verify through appropriate channels the validity of the license. This may prove to be a very time-consuming process, especially given the limited parameters of a traffic stop. It would seem that to require officers to pursue the validity of this license, and not necessarily immediately pursue the validity of any other license from a foreign jurisdiction, poses a problem.
Additionally, the peace officer is required, within five (5) days of the stop to forward copies of all documents to the United States Department of State. Documents created may or may not be available to send within the five (5) day period, depending on the nature of the incident, accident, or citation.
It is unknown whether passage of SB759 has any effect on any other federal, state, or local matching fund or appropriation.
ADMINISTRATIVE IMPLICATIONS
SB759 may affect entities in which peace officers perform their duties where the cost of providing a service to the community is affected by administrative function of verifying the validity of the license.
