SUMMARY
Synopsis of Bill
The bill provides that the State Engineer determine all rights to the use of the water by rural domestic water systems.
Significant Issues
The bill secures water rights which were previously diversions from ditches, springs, rivers or shallow wells for rural domestic water systems. The minimum water rights of a domestic water system is determined by the average statewide per person diversion. The determination shall not result in a reduction of existing diversions.
FISCAL IMPLICATIONS
SB 697 contains no appropriation. Determining the minimum water right for a rural domestic system would be an easy calculation for the State Engineer. Establishing the water right on the number of users of the water system would not require significant additional expenditures.
