SUMMARY
Synopsis of SIAC Amendments
The Senate Indian and Cultural Affairs Committee amendment specifically creates a "tribal library program" in the Library Division of the Office of Cultural Affairs. The amendment also transfers the administration of the Tribal Libraries Endowment Fund to the Tribal Library Program of the Library Division.
The amendment requires the Library Division to consult with the tribal librarians in the adoption of rules and procedures to administer the Fund.
Synopsis of Original Bill
SB 546 appropriates $1 million from the general fund to create the Tribal Libraries Endowment Fund for the purpose of funding the establishment, development and administration of tribal libraries in New Mexico.
Significant Issues
Tribal history is a significant portion of New Mexico's history. Tribes may not have the resources to create or maintain libraries to preserve this history.
FISCAL IMPLICATIONS
The appropriation of $1000.0 contained in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance remaining at the end of any fiscal year shall not revert to the general fund. This bill also creates a new Tribal Libraries Endowment Fund with the general appropriation.
Continuing Appropriations
This bill creates a new fund and provides for continuing appropriations. The LFC objects to including continuing appropriation language in the statutory provisions for newly created funds. Earmarking reduces the ability of the legislature to establish spending priorities.
