SUMMARY



Synopsis of Bill



Senate Bill 383 creates a new section of the Liquor Control Act. The bill, if enacted, would prohibit a licensee, lessee or an employee of a licensee or lessee to consume alcoholic beverages at any time at which they are mixing, pouring, serving, selling or delivering alcoholic beverages to a customer.



Significant Issues



Currently, there is no prohibition for a licensee, lessee or employee to consume alcoholic beverages during the time they are performing their duties as a server.





PERFORMANCE IMPLICATIONS



The potential for this bill requiring more administrative hearings might increase the average number of days it takes the division to conduct a hearing.



ADMINISTRATIVE IMPLICATIONS



Because consuming alcoholic beverages by a licensee, lessee or employee would become a violation, additional citations are anticipated, however, it is unknown to what extent administrative impact to the division would be.
