SUMMARY



Synopsis of Bill



Senate Bill 376 appropriates $100.0 from the general fund to the Department of Finance and Administration for the purpose of contracting for youth club activities in certain neighborhoods of Santa Fe.



Significant Issues



Support for youth club activities in Santa Fe in practice has meant support for the Santa Fe Boys and Girls Club, a private non-profit organization serving 4500 K-12 children with outside-school activities. Club programs promote youth development and aim to prevent delinquency among youth through activities designed to build educational and recreational skills. The Santa Fe Boys and Girls Club is supported through foundation grants, contributions and fund-raising activities.



FISCAL IMPLICATIONS



The appropriation of $100.0 contained in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance remaining at the end of fiscal year shall revert to the general fund.



The General Appropriation Act of 2000 contained an appropriation of $50.0 for the operation of the Boys and Girls Clubs in Santa Fe.



OTHER SUBSTANTIVE ISSUES



To the extent that this bill amounts to conferring a gift or a grant on a private entity, it implicates the antidonation clause of the New Mexico constitution. That clause prohibits the state and counties from making any donation, grant or gift to private persons or entities without sufficient consideration in return.
