SUMMARY
Synopsis of HGUAC Amendment
The House Government and Urban Affairs Committee amendment to House Joint Resolution 1 provides that the Governor's appointee to fill a vacancy in the Lieutenant Governor position will not take office until he/she is confirmed by a majority vote of both houses of the Legislature.
Synopsis of Original Bill
The Joint Resolution proposes a constitutional amendment that would allow the Governor to appoint the Lieutenant Governor, should a vacancy occur.
Significant Issues
The Joint Resolution would amend the New Mexico Constitution and alter the current succession process. It would allow the Governor to fill a Lt. Governor vacancy by appointment. In addition, if the Lt. Governor filled a vacant Governor position, then he/she would be able to appoint their Lt. Governor, and both will hold the respective offices until the next general election.
FISCAL IMPLICATIONS
There is no appropriation or other significant fiscal implications within the bill. However, there are costs associated with the Secretary of State's budget. Such costs include printing and advertising in various languages and publications, distribution of information regarding the proposed amendment, and additional costs in relation to additional items on ballots. The Secretary of State indicates this is a $30.0 cost, which is found in their base operating budget.
