Synopsis of the House Floor Amendment
This amendment changes the title of the bill to the following:
AN ACT
RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE;
MAKING AN APPROPRIATION FOR DEVELOPMENT OF REGIONAL WATER
SUPPLY OPPORTUNITIES IN THE RIOS NAMBE, POJOAQUE AND TESUQUE
STREAM SYSTEMS.
Synopsis of Original Bill
This bill appropriates $100.0 from the general fund to the Office of the State Engineer (SEO) for the purpose of supporting the development of regional water supply opportunities for the residents of the Rios Nambe, Pojoaque and Tesuque stream systems.
Significant Issues
The court decision in State ex rel. State Engineer v. Aamodt, et al. limited the water rights to the actual water used for domestic purposes between 1946 and 1924. This amount is insufficient to meet the projected needs of these pueblos. This appropriation will allow SEO to find additional water resources to meet the needs of the Rios Nambe, Pojoaque and Tesuque pueblos.
FISCAL IMPLICATIONS
The appropriation of $100.0 contained in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2002 shall revert to the general fund.
