SUMMARY



Synopsis of Bill



House Bill 852 repeals Section 47-8A-1 NMSA 1978 which prohibits rent control ordinances from being enacted by political subdivisions or home rule municipalities.



Significant Issues



This bill does not impair the right of state agencies, counties or municipalities to control their property. It also would not apply to private property under contract with federal, state or local governments to provide low income housing. By repealing the specified section in statute, local political subdivisions would make decisions based on their particular needs to allow or disallow rent control. This bill would not prohibit rent control nor does it mandate them.



A review of this bill indicates no fiscal impact should result from passage of this measure; therefore, an in-depth analysis of technical and other issues has not been conducted by the staff.
