SUMMARY

Synopsis of HAFC Amendment

The House Appropriations and Finance Committee amendment strikes the $50.0 appropriation in the bill. Since HAFCS/H2,4,5,6,7 & 8 and HECS/H4 does not currently contain an appropriation for this purpose, the costs of the committee would presumably be paid from the appropriation for interim legislative expenses in Subsection B of Section 3 of House Bill 1 (Feed Bill) already approved by the governor.

Synopsis of Bill

House Bill 306 creates the Joint Interim Legislative Redistricting Committee and appropriates $50.0 from the general fund to the Legislative Council Service for the purposes of staffing the committee and reimbursing the per diem and mileage expenses of the committee.

The bill provides that the committee be composed of 16 members: 8 House members appointed by the Speaker of the House and 8 Senate members appointed by the Committee's Committee of the Senate, in same proportion as the two major parties in each house.

The duties of the committee are to:

•examine statutes, constitutional provisions, rules and court decisions governing redistricting in New Mexico;
•use the guidelines for redistricting adopted by the Legislative Council so that the procedures, criteria and standards for redistricting plans meet statutory and constitutional requirements;
•conduct public hearings to provide a forum for public involvement to the 45^th Legislature; and
•recommend appropriate redistricting legislation to the 45^th Legislature.

The bill also provides for the use of subcommittees. Staff will be provided by the Legislative Council Service.

Significant Issues

Article IV, Section 3(D) of the Constitution of New Mexico authorizes the Legislature to reapportion its districts following a federal decennial census.

In addition to legislative redistricting, the redistricting plan of the interim committee will include a plan to address redistricting for Congressional, Public Regulation Commission, State Board of Education and Magistrate Court districts. A special session will be called later this year to address redistricting.

FISCAL IMPLICATIONS

The appropriation of $50.0 contained in this bill is a nonrecurring expense to the general fund for expenditure in FY01 and FY02. Any unexpended or unencumbered balance remaining at the end of FY02 shall revert to the general fund.

ADMINISTRATIVE IMPLICATIONS

The Legislative Council Service will provide staff to support the work of the committee. In addition, House Bill 1, the Feed Bill, contains $682.0 for expenditure from FY01 through FY03 for legal and technical services related to reapportionment; therefore, such legal and technical services have already been provided for.
