AN ACT

RELATING TO LIABILITY FOR CIVIL DAMAGES; PROVIDING LIMITED LIABILITY FOR CERTAIN PERSONS WHO ARE TRANSPORTING CERTAIN INTOXICATED INDIVIDUALS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. GOOD SAMARITAN LAW--TRANSPORTATION OF INTOXICATED PERSONS.--No person, who, in good faith, transports an intoxicated person, who has been detained for driving under the influence or public intoxication, from the custody of law enforcement personnel directly to a hospital, shelter, residence or other safe place, shall be held liable for any civil damages as a result of any action or omission in providing that transportation, except when liable for an act of gross negligence; but nothing in this section applies to the provision of transportation when it is rendered for remuneration or with the exception of remuneration.
