RELATING TO EDUCATION; PLACING THE INDIAN EDUCATION DIVISION IN THE OFFICE OF THE SUPERINTENDENT OF PUBLIC INSTRUCTION; REQUIRING THE INDIAN EDUCATION DIVISION TO DEVELOP A PLAN AND IMPROVE THE RESULTS OF STATE EDUCATION OF INDIAN CHILDREN.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 22-2-11 NMSA 1978 (being Laws 1975 (1st S.S.), Chapter 8, Section 1) is amended to read:

"22-2-11. INDIAN EDUCATION [SECTION] DIVISION CREATED--DUTIES.--

A. The "Indian education division" is created [within the state department of education] and attached directly to the office of the state superintendent.

B. The budget of the Indian education division shall be set forth separately from all other divisions of the department of education.

C. The director of the Indian education division shall report directly to the state superintendent.

D. It is the duty of the Indian education division to identify impediments that Native American children face in obtaining their diplomas and develop a corrective action plan to correct the deficiencies that prevent the success of Native American children in public school.

E. The Indian education division shall develop intervention strategies that can be used by teachers and other school staff to prevent the failure of Native American students attending public schools.

F. The Indian education division shall establish performance measures that will enable evaluation of the corrective action plan and will help the department of education and the legislature determine the success of the strategies developed to improve the success of Native American students in public schools and improve the retention rate of Native American students in public schools."
