AN ACT

RELATING TO CRIMES; MAKING A REFERRAL TO AN ATTORNEY OR A BAIL BONDSMAN BY A LAW ENFORCEMENT OFFICER OR DETENTION OFFICER A FOURTH DEGREE FELONY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Criminal Code is enacted to read:

"[NEW MATERIAL] ILLEGAL FOR BAIL BONDSMAN OR JAIL PERSONNEL TO REFER TO ATTORNEY--PENALTY.--

A. Illegal referral consists of a law enforcement officer or a detention officer intentionally referring a person detained in jail or awaiting detention in jail to a specific attorney or bail bondsman.

B. Whoever commits illegal referral is guilty of a fourth degree felony."
