Your CONSERVATION COMMITTEE, to whom has been referred

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 11, strike "AND ARBITRATION".

2. On page 1, line 17, before "MEDIATION" insert "GOOD FAITH NEGOTIATION AND" and strike "AND ARBITRATION".

3. On page 1, line 23, after "and" insert "reasonable" and strike "mediation" and insert in lieu thereof "negotiations".

4. On page 2, line 2, strike "If mediation fails to" and strike all of lines 3 through 5.

5. On page 2, between lines 5 and 6, insert the new subsection B to read:

"B. If the state engineer, the attorney general and the water claimant are unable to reach agreement through negotiations, the parties shall participate in mediation prior to the water rights being adjudicated in a court proceeding.".

6. Reletter succeeding subsections accordingly.

7. On page 2, line 6, strike "process".

8. On page 2, line 8, strike "involve" and insert in lieu thereof "include".

9. On page 2, line 8, after "acequia" insert a period.

10. On page 2, line 9, strike "and all" at the beginning of the line and insert in lieu thereof "All".

11. On page 2, line 12, after "No" insert "individual" and after "made" insert "to water rights claimants within irrigation districts, conservancy districts or acequias".

12. On page 2, line 13, strike "full".

13. On page 2, line 13, strike "irrigation or conservancy".

14. On page 2, line 14, after the first "and" insert "allowing" and strike the second "and" and insert in lieu thereof "with the".

15. On page 2, line 17, after "finalized" insert "as to water rights within an irrigation district, conservancy district or acequia".

16. On page 2, line 18, strike "participated" and insert in lieu thereof "had the opportunity to participate".,

and thence referred to the JUDICIARY COMMITTEE.
