AN ACT

RELATING TO EDUCATION; CHANGING HOME SCHOOL REQUIREMENTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 22-1-2.1 NMSA 1978 (being Laws 1985, Chapter 21, Section 2, as amended by Laws 1993, Chapter 62, Section 2 and also by Laws 1993, Chapter 226, Section 1) is amended to read:

"22-1-2.1. HOME SCHOOL--REQUIREMENTS.--Any person operating or intending to operate a home school shall:

A. within thirty days of its establishment, notify [the superintendent of schools of the school district in which the person is a resident of the establishment of a home school within thirty days of its establishment and notify the superintendent of schools of the school district on or before April 1 of each subsequent year of operation] in writing the administration of the school district from which the home school is drawing students;

B. maintain records of student [attendance and] disease immunization [and furnish such records to the superintendent of schools of the school district] or a waiver of that requirement; and

C. provide instruction by a person possessing at least a high school diploma or its equivalent [and

D. test students annually to assess student achievement according to the statewide and local school district testing programs as determined by the state superintendent. The home school child shall take such achievement tests at a time and place and in a manner consistent with the procedures established by the state superintendent]."
