RELATING TO THE PUBLIC REGULATION COMMISSION; CLARIFYING RESIDENCE; ALLOWING FOR REIMBURSEMENT OF CERTAIN PER DIEM AND MILEAGE EXPENSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. Section 8-7-3 NMSA 1978 (being Laws 1997, Chapter 262, Section 3) is amended to read:
"8-7-3. RESIDENCE.--At the time of filing a declaration
of candidacy for the office of public regulation commission
member, a candidate shall reside in the district for which he
files. If [any elected] a member of the public regulation
commission permanently removes his residence from [or
maintains no residence in] the district from which he was
elected or appointed, he shall be deemed to have resigned and
his successor shall be selected as provided in the Public
Regulation Commission Apportionment Act."
Section 2. A new section of the Public Regulation Commission Act is enacted to read:
"[NEW MATERIAL] COMMISSIONERS--PER DIEM AND MILEAGE.--Commissioners who are traveling on official business may receive per diem and mileage as provided in the Per Diem and Mileage Act from either their home or their duty station, whichever is applicable; provided, however, they may not receive per diem and mileage for commuting between their home and duty station."
Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2001.
