SENATE FLOOR AMENDMENT number _1_____ to SENATE BILL 331, as

amended

Amendment sponsored by Senator Roman M. Maes, III

1. On page 106, lines 17 and 20, after "failed" insert "for a period of thirty days".

2. On page 120, lines 19 and 20, strike "83 through 98" and insert in lieu thereof "84 through 100".

3. On page 120, between lines 21 and 22, insert the following new section:

"Section 85. [NEW MATERIAL] DEFINITIONS.--As used in the Foreign Business Trust Registration Act:

A. "business trust" means an entity engaged in a trade or business that is created by a declaration of trust that transfers property to trustees, to be held and managed by them for the benefit of persons holding certificates representing the beneficial interest in the trust estate and assets; and

B. "foreign business trust" means a business trust formed under the laws of a state other than New Mexico.".

4. Renumber the succeeding sections accordingly.
