SENATE FLOOR AMENDMENT number __1___ to SENATE PUBLIC AFFAIRS COMMITTEE SUBSTITUTE FOR SENATE BILL 319

1. On page 3, line 20, after "shall" insert "be in accordance with federal law and regulations and shall".
2. On page 16, between lines 11 and 12, insert the following new section:
"Section 12. TEMPORARY PROVISION.--
A. During the period from July 1, 2001 and the effective date of rules promulgated by the secretary of health pursuant to Section 4 of this act, a person who would be eligible to participate in the medical use of marijuana program as a certified patient, but for the lack of effective regulations establishing procedures for certification and participation, may be certified as suffering from a debilitating medical condition by a practitioner and upon presentation of that certification to the secretary of health, the secretary may issue a temporary certification for participation in the program. The secretary shall maintain a list of all temporary certificates issued pursuant to this section. A person possessing a temporary certificate and his primary caregiver are not subject to arrest, prosecution, civil or criminal penalty or denial of any right or privilege for possessing marijuana if the amount of marijuana possessed collectively is not more than is reasonably necessary to ensure the uninterrupted availability of marijuana for the purpose of alleviating the symptoms or effects of the person's debilitating medical condition.
B. Thirty days after the effective date of the secretary of health's rules promulgated pursuant to Section 4 of this act, this section is repealed.".
3. Renumber the succeeding sections accordingly.
