AN ACT

RELATING TO ELECTIONS; PROVIDING THAT A VOTER SHALL NOT BE PERMITTED TO VOTE A STRAIGHT PARTY TICKET IN A GENERAL ELECTION; REPEALING AND ENACTING SECTIONS OF THE ELECTION CODE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Election Code is enacted to read:

"[NEW MATERIAL] GENERAL ELECTIONS--PROHIBITION ON VOTING A STRAIGHT PARTY TICKET.--

A. Ballots shall not be designed to permit a voter to vote a straight party ticket in a general election.

B. Electronic voting machines shall not be programmed to permit a voter to vote a straight party ticket in a general election."

Section 2. REPEAL.--Sections 1-9-4 and 1-12-53 NMSA 1978 (being Laws 1969, Chapter 240, Section 187 and Laws 1977, Chapter 222, Section 56, as amended) are repealed.

Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2001.
