Mr. Speaker:

Your VOTERS AND ELECTIONS COMMITTEE, to whom has been referred

HOUSE BILL 931

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 19, before "The" insert the subsection designation "A.".

2. On page 1, line 24, strike the closing quotation mark.

3. On page 1, between lines 24 and 25, insert the following new Subsection B to read:

"B. As used in Chapter 1, Article 9 NMSA 1978, "voting system" means a combination of mechanical, electromechanical or electronic equipment, including the software and firmware required to program and control the equipment, that is used to cast and count votes; equipment that is not an integral part of a voting system, but that can be used as an adjunct to it, is considered to be a component of the system."".

4. On page 2, between lines 2 and 3, insert the following new Subsection A to read:

"A. All voting systems approved for use in New Mexico shall meet federal election commission standards and conform to state information technology rules, standards and practices and be tested by an independent authority.".

5. Reletter the succeeding subsections accordingly.

6. On page 9, line 2, after "used" strike the comma and the remainder of the line and all of lines 3 through 9 and insert in lieu thereof a period.

7. On page 11, lines 5 and 6, strike "director of the information systems division of the general services department" and insert in lieu thereof "state chief information officer".

and thence referred to the APPROPRIATIONS AND FINANCE COMMITTEE.
