Your APPROPRIATIONS AND FINANCE COMMITTEE, to whom has been referred

HOUSE BILL 894

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 12, after "TAX" strike the remainder of the line and insert in lieu thereof a period.

2. On page 3, lines 5 and 6, strike "public regulation commission" and insert in lieu thereof "energy, minerals and natural resources department".

3. On page 5, line 15, strike "public regulation commission" and insert in lieu thereof "energy, minerals and natural resources department".

4. On page 6, line 15, strike "PUBLIC REGULATION COMMISSION" and insert in lieu thereof "ENERGY, MINERALS AND NATURAL RESOURCES DEPARTMENT".

5. On page 6, line 19, strike "public regulation commission" and insert in lieu thereof "energy, minerals and natural resources department".

6. On page 6, line 21, after the period insert "If so verified, the taxpayer may then apply for approval of the production tax credit once the generation facility is producing electricity. For the purposes of determining the order in which the department has received applications, the date on which the application for the tax credit is approved by the department shall be considered the taxpayer's original date of application for the credit.".

7. On page 6, line 21, strike "commission" and insert in lieu thereof "department".

8. On page 6, line 25, strike "public regulation commission" and insert in lieu thereof "energy, minerals and natural resources department".

9. On page 7, line 3, after the period insert "The department may estimate what the annual production potential is for an applicant's generation facility for the purposes of determining when the annual limit on tax credit claims is reached.".

10. On page 7, lines 7 and 8, strike "months in a year" and insert in lieu thereof "consecutive months".

11. On page 7, line 9, strike "public regulation commission" and insert in lieu thereof "energy, minerals and natural resources department".

12. On page 7, line 14, strike "public regulation commission" and insert in lieu thereof "energy, minerals and natural resources department".

13. On page 7, line 17, before the period insert ", the types of generation facilities for which tax credits have been approved and the amount of energy produced by those facilities".

14. On page 7, lines 18 through 24, strike Section 5 in its entirety.

15. Renumber the succeeding section accordingly.
