RELATING TO HEALTH; PROVIDING FOR CONSULTATION WITH THE LEGISLATURE ON MATTERS INVOLVING THE FEDERAL SOCIAL SECURITY ACT; PROVIDING FOR ACCESS TO INFORMATION; ENACTING A NEW SECTION OF THE PUBLIC ASSISTANCE ACT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the Public Assistance Act is enacted to read:
"[NEW MATERIAL] CONSULTATION WITH THE LEGISLATURE--ACCESS TO INFORMATION.--
A. The department shall consult with the legislature before the department submits a request for a modification, amendment or waiver to Title 19, Title 21 or other program of the federal act.
B. If the legislature is not in session, the department shall consult with the legislative health and human services committee and the legislative finance committee.
C. The department shall provide access to the legislature and the public to all records, reports, correspondence and information relating to the administration of the programs in Subsection A of this section that are not specifically held confidential by law."
