RELATING TO HEALTH INSURANCE; REQUIRING CERTAIN COVERAGE BY HEALTH MAINTENANCE ORGANIZATIONS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of Chapter 59A, Article 46 NMSA 1978 is enacted to read:
"[NEW MATERIAL] CHIROPRACTIC PHYSICIANS--MIDWIVES.--
A. If chiropractic physicians, licensed pursuant to Chapter 61, Article 4 NMSA 1978, are willing to meet the terms and conditions offered by a health maintenance organization, they shall not be excluded from a health maintenance organization.
B. If midwives, both registered lay midwives and certified nurse-midwives, are willing to meet the terms and conditions offered by a health maintenance organization, they shall not be excluded from a health maintenance organization.
C. For purposes of this section:
(1) "certified nurse-midwife" means any person who is licensed by the board of nursing as a registered nurse and who is registered with the department of health as a certified nurse-midwife; and
(2) "registered lay midwife" means any person who practices lay midwifery and who is registered as a registered lay midwife with the department of health."
Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2001.
