Your BUSINESS AND INDUSTRY COMMITTEE, to whom has been referred

HOUSE BILL 318

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 14, after "SALES" insert "; EXEMPTING CERTAIN SALES".

2. On page 1, line 22, strike "Subsection B" and insert in lieu thereof "Subsections B and C".

3. On page 1, line 25, strike "retail" and insert in lieu thereof "a retail location in New Mexico".

4. On page 2, between lines 19 and 20, insert the following:

"C. The provisions of this section shall not apply to written, telephone or electronic sales, including sales by mail order, fax machine or the internet.

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is January 1, 2002.".,

and thence referred to the JUDICIARY COMMITTEE.
