RELATING TO CORRECTIONS; PLACING CONDITIONS ON CONTRACTS TO PROVIDE TELEPHONE SERVICES TO INMATES IN STATE CORRECTIONAL FACILITIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. CONTRACTS TO PROVIDE TELEPHONE SERVICES TO INMATES IN STATE CORRECTIONAL FACILITIES--CONDITIONS.--
A. A contract to provide telephone services to inmates in state correctional facilities shall be negotiated and awarded in a manner to:
(1) provide for the lowest reasonable costs to inmates in state correctional facilities, their families and their loved ones;
(2) pay for reasonable expenses incurred by the corrections department related to negotiating and administering the contract; and
(3) pay for reasonable expenses incurred by the corrections department related to supervising and monitoring inmate's telephone conversations.
B. The realization of profits by the corrections department shall not be a basis for awarding a contract for the provision of telephone services to inmates in state correctional facilities.
