Synopsis of the COW Amendment



The Senate Committee of the Whole amendment to Senate Bill 1 ensures that if an identical bill to Senate Bill 1 is passed by the Legislature and enacted into law, only a single appropriation can be made to the State Parks Division for each revenue source, which have been identified in the appropriation table above.



Synopsis of Bill



Senate Bill 1 appropriates $4,307.3 to the State Parks Division (SPD) of the Energy, Minerals and Natural Resources Department (EMNRD) for the remaining quarter of fiscal year 2000. The bill contains a reversion and emergency clause.



Significant Issues



The SPD is a non-reverting agency [Section 16-2-19 NMSA 1978]. The section states clearly,



"All money derived from the operation of state parks or recreation areas or . . . appropriated for state park and recreation purposes by the legislature or acquired from any other source whatsoever, shall not at any time or in any event revert or be transferred to general or other state funds . . ."



FISCAL IMPLICATIONS



Aside from the appropriation made in the bill, enactment of Senate Bill 1 would not have a fiscal impact on the SPD. If Senate Bill 1 is not enacted, the state parks will close on or about April 7, 2000 until a sufficient appropriation is made to the division.
