A JOINT RESOLUTION

PROPOSING TRANSFER OF OWNERSHIP OF REAL PROPERTY AT THE SANTA TERESA BORDER CROSSING IN DONA ANA COUNTY TO DONA ANA COUNTY.



WHEREAS, Section 13-6-3 NMSA 1978 requires ratification

and approval of any sale, trade or lease of state property over one hundred thousand dollars ($100,000) in value; and

WHEREAS, the property control division of the general services department built water and wastewater treatment systems to support the new border crossing facility at Santa Teresa in Dona Ana county with one million dollars ($1,000,000) in severance tax bond proceeds and one million one hundred sixteen thousand fifty dollars ($1,116,050) from the state road fund pursuant to legislative authorization; and

WHEREAS, construction of the systems is complete, and Dona Ana county has requested transfer of the property to the county; and

WHEREAS, the property control division proposes to transfer ownership of the water and wastewater treatment systems located at Santa Teresa, New Mexico to Dona Ana county in exchange for Dona Ana county assuming the state's contractual obligations to provide water and wastewater treatment services to the federal facilities at the Santa Teresa border crossing and for other good and valuable consideration to be negotiated by the state and the county;

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the proposed transfer of the real property be hereby ratified and approved; and

BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the property control division of the general services department and the board of county commissioners of Dona Ana county.
