Synopsis of Bill



Senate Joint Memorial 51 requests that the State Board of Education (SBE) and State Department of Education (SDE) create a task force to study and recommend rules for consideration by the SBE to ensure collective bargaining rights for public school employees and their exclusive representative.



The memorial requests that the task force be composed of public members, members of the legislature, representatives of the SBE, school employees, representatives of the New Mexico federation of teachers and the national education association and representatives of school management.



Significant Issues



This memorial is introduced because the Collective Bargaining Act expired (sunset clause) and subsequent attempts to extend it were vetoed. The drafting of rules to cover collective bargaining is a new "experience" for the SBE, but expertise appears to be readily available to assist the SDE and the SBE in carrying out the request of the memorial.



FISCAL IMPLICATIONS



None.



ADMINISTRATIVE IMPLICATIONS



SDE will have to conduct the study using existing staff and resources.



TECHNICAL ISSUES



The memorial does not indicate a completion date for the adoption of the proposed rules nor does it state whether a report is to be submitted to a legislative committee
