Synopsis of Bill

SJM 46 opposes the ratification of the proposed Biodiversity Treaty. The bill if enacted will ascertain that the legislature is opposed to the inclusion of any land in the biosphere program within the border of the state of NM and within the purview of the Biodiversity Treaty, without the consent on NM legislature. The bill urges members of congress of the US and especially the NM delegation to oppose ratification of the treaty and the inclusion of any land within NM in the biosphere program. Copies of SJM 46, if enacted, will be transmitted to the President, the Secretary of State and the NM congressional delegation.

Significant Issues

SJM 46 points out:

•the biosphere program threatens to place millions of acres of land under the control of the United Nations.

•the United Nations (UN) has created a worldwide system of 328 biosphere reserves in 82 nations.
•that 47 UN-designated biosphere reserves are within the US and 1 biosphere is within the state of NM.

•that the NM legislature and the US congress have not considered or approved such a designation.

•that such designations require strict land use management procedures and are set forth in the 1994 strategic plan for the US.

•that biosphere reserves are, by definition, designed to continually expand each of the three zones.

•that no landowner within the reach or potential reach of the biosphere reserves has input or recourse to land use management policies of the UN.

•that the use of land in biosphere areas for ordinary commercial or agricultural purpose may be severely restricted or eliminated.

•that the area encompassed by this reserve includes not only public, but private land.
